WrAWiki is a place to showcase your characters and stories to other players on our server. As creative people we need to respect the works of other creative people. Therefore, we ask that if work isn't yours and you don't have permission to use it, to not use it.
What is a Copyright
A copyright is a legal right created by the law of a country that grants the creator of an original work exclusive rights for its use, modification, and distribution. Distribution means to print, publish, perform, film, or record literary, artistic, or musical material. A copyright has a duration, but the duration is usually 50 years after the death of the person who created the work.
Many countries have copyrights, and the Berne Convention dictates that anything that can be copyrighted is copyrighted on the date of inception regardless of if you put the copyright symbol and info on it or not. This treaty was accepted in many countries, some so small you've probably never even heard of them.
This means that no, you may not use a piece of artwork just because it doesn't have a copyright notice on it.This means, no, putting "no copyright intended" is not an acceptable disclaimer, because by using someone else's artwork without permission you are in fact violating their legal rights.
What about Fair Use?
Fair Use (in US copyright law) the doctrine that brief excerpts of copyright material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without the need for permission from or payment to the copyright holder. None of these situations really apply to this wiki. Fair Use is an affirmative legal defense for copyright lawsuits, it does not protect you against a lawsuit and what is and isn't considered fair use is ultimately determined by the courts.
Can I use this image
- Did you make it yourself? If you answered yes, then yes. If you answered no then continue.
- Did you pay for it? If you answered yes, then yes, else continue. You must include Template:Commissioned in the image file description. You must give the artist attribution.
- Does it belong to Blizzard Entertainment? If you answered yes, then yes, you may because Blizzard has a fan site policy that allows users to use Blizzard work with credit. You must include Template:Blizzard Copyright on the upload.
